This permit is managed directly by the employer through the Immigration Office in the region where the services will be provided, or online through the Public Administration’s electronic headquarters.

The initial authorization is valid for 1 year and is limited to a specific geographical area and occupation. Afterward, it can be renewed for up to 4 additional years, provided the necessary conditions are met.

Requirements to Obtain the Temporary Residence and Work Permit for Employment

Both the worker and the employer must meet certain conditions to obtain this permit. Below are the key requirements:

Requirements for the Worker:

  1. Not being a citizen of the EU, EEA, or Switzerland, or a relative of a citizen from these countries who enjoys Union citizen status.
  2. Not residing in Spain irregularly.
  3. Having no criminal record in Spain or in any country where the worker has resided in the past five years.
  4. Not being banned from entering Spain or listed as a rejectable person in countries with which Spain has signed agreements.
  5. Not being under a return commitment to Spain if the worker has benefited from a voluntary return program.
  6. Pay the corresponding fees for the permit processing.
  7. The national employment situation must allow the hiring (either due to a shortage of workers in certain jobs or an exemption based on specific circumstances).
  8. Possess the professional qualification or the legal qualification required for the job, duly recognized if necessary.

Requirements for the Employer or Company:

  1. Present a signed employment contract that guarantees continuous work for the worker during the validity of the permit.
  2. Submit documentation proving the financial capacity of the company, such as the latest Personal Income Tax (IRPF) return or other documents certifying the employer’s ability to support the worker’s expenses.
  3. If the employer is a legal entity, they must also submit a copy of the company’s tax identification number (NIF), the deed of incorporation, and documents certifying the legal representation of the company.

What Documentation is Needed to Apply for the Permit?

The employer must provide several documents when applying for the temporary residence and work permit for employment:

  1. A complete copy of the worker’s passport.
  2. A copy of the documents proving the worker’s qualifications and any necessary professional licenses for the job.
  3. If the employer is a legal entity, submit the company’s NIF, the deed of incorporation, and the representation documents.
  4. A signed employment contract, in both original and copy.
  5. Documents proving that the national employment situation allows for the hiring, or that the specific job is exempt from employment restrictions.

Domestic Service Employment:

If the permit is requested for hiring a foreign worker in domestic service, additional documents must be provided:

  • A copy of the employer’s NIF or NIE.
  • A copy of the most recent IRPF return or any documentation proving the employer’s financial solvency (such as tax certificates).

Application Process and Decision

The application must be initiated by the employer at the Immigration Office in the province where the job will take place or online through the Public Administration’s electronic headquarters.

The application decision is made within a maximum of three months from the day after the application is submitted. If there is no response within that period, the application is considered denied by negative administrative silence. However, the request may still be approved later, so it is important to continue following up on the process.

Renewal of the Temporary Residence and Work Permit for Employment

The initial permit is valid for 1 year. At the end of this period, if the conditions remain the same, the employer can apply for a renewal for an additional 4 years. For the renewal, the worker must still be employed and meet the legal requirements.

Worker’s Obligations After Permit Approval

Once the permit is approved and the worker is registered in the Social Security system, they have one month to apply for the Foreigner’s Identity Card (TIE), which proves their legal residency and right to work in Spain.
